Rule 40
Allocation of Seats towards Elections Under Proportional Electoral System

(1) According to sub-rule (7) of rule 39, after receiving the vote counting table of the election held in accordance with the proportional election system from all constituencies of the respective province, the election officer according to rule 13 must determine the total number of votes received by the party.
(2) Based on the total votes received by the party in accordance with sub-rule (1), such election officer shall determine the number of seats to be obtained by the party under section 60 and sub-rule (2) of rule 14 and submit it to the Commission.
(3) When determining the number of seats to be obtained by the party according to sub-rule (2), on the basis of the number of seats obtained by such party, according to sub-section (4) of section 60 of the Act, thirty-three percent of the total number of members representing such party in the Provincial Assembly should be included in the name of women. In proportion to the number of women and the number of candidates from various inclusive groups included in the closed list of candidates in accordance with sub-rule (2) of Rule 14, such party shall also determine the number to be represented from other inclusive groups on the basis of the vote result dividing formula as per sub-section (2) of section 60 of the Act.
(4) According to sub-rules (2) and (3), the number of seats to be obtained and represented by the respective parties shall be approved by the Commission.
